Mediation.


Among the methods of conflict resolution, we find the figure of mediation. It is a management method that involves the participation of a third party, the mediator, who helps the parties improve communication in order to resolve their disagreements and preserve personal relationships.

The mediator acts in a neutral and impartial manner, using a series of techniques and/or skills that he makes available to the parties in search of agreements.

Mediation is a quick, inexpensive and confidential way to resolve disputes compared to a court process.

It does not imply giving up any rights. If no agreement is reached, once the mediation is completed, legal proceedings can be initiated if they wish.

The flexibility that mediation provides is highly valued, since the agreements can be more creative, unlike through judicial means, in which the solutions are usually more limited. In mediation, agreements are reached that are more adapted to the needs and with a high probability of compliance.

While the judge, when handing down a sentence, must limit himself to upholding or rejecting the claim that has been presented in the lawsuit, the mediation agreement can include everything that the parties consider appropriate, whether or not it has legal content and whether or not it was the subject of of his initial approach to the controversy.


Civil mediation.

Family mediation.

Mediation is not a method to be used only in cases of conflicts between people in their private sphere. Frictions also arise in the business world for which it can be very useful:

  • Conflicts between companies.
  • Conflicts between partners.
  • Conflicts between Administrator and other partners.
  • Conflicts between suppliers and clients.

Neighborhood/community mediation.

It is one of the most common mediations, those whose origin is in conflicts within the community in which we live.

It is the one that deals with the resolution of neighborhood and social conflicts, between people from the same urbanization, the same neighborhood, municipality, etc.

This type of mediation often helps not only to resolve existing conflicts, but also to prevent future conflicts that may arise, laying a good foundation for understanding.
